These are the general terms and conditions for the Internet services of SIRM (referred to hereinafter as the provider) at www.sirm.ch (referred to hereinafter as the URL). Published on 13 January 2017.
1. General information
The following conditions are intended to regulate the mutual relationship for the use of Internet services between potential & existing clients and the provider.
The provider makes it possible for potential & existing clients to get in touch with the provider, also in electronic form, via Internet and to use the specific online services provided at the URL. These conditions are an addition to and not a modification of the individual, product-specific terms and conditions of business and contract. Communication of the business transactions can take place as required on screen and by e-mail. An e-mail address is a distinct advantage. By accessing this URL, you agree to these conditions.
2. Customer identification
Visitors can use the public area of the URL without any specific identification. If personal details are transferred to the provider, further access may require a user name, an e-mail address and a personal password. Whoever identifies him/herself with a user name or e-mail address and password is deemed accordingly legitimized by the provider. The provider can thus allow the client to make inquiries or use services and/or can also accept orders and legally-binding information and messages within the scope of the selected business and type of use without any further verification of the client’s authorization. This is also the case even if the person concerned is not the person actually authorized.
Users undertake to keep any user names and passwords secret and to protect them from being used improperly by unauthorized persons. The users bear all risks which arise from careless use of the identification features (user name, e-mail address, password).
The provider has the right at any time and without specifying the reasons, in particular in the case of security risks, to refuse access to client data or to delete or change user name and password. In such cases, the provider can demand that the user legitimize him/herself in another form (with a signature).
3. Operating hours
The URL can be used 365 days a year. The provider reserves the right to interrupt access to services in justified cases (e.g. for maintenance purposes). The provider cannot accept any liability for damage resulting from such interruptions or interruptions which are caused by the hosting partner.
4. Security
Great attention was paid by the provider to security and trouble-free operation when using the website. In spite of the best possible technical provisions, security and trouble-free operation, as well as the confidentiality of data and/or content cannot be guaranteed by the provider.
5. Liability
The provider cannot accept any liability for the correctness and completeness of the data displayed or of data transmitted by telephone or electronically. In particular, the provider cannot be made liable by the user for damage arising from: transmission errors, technical defects, interference or disruptions of the telephone network/Internet access, illegal interventions in network setup, the smuggling in of viruses, copying and falsifying data and content, overloaded networks, non-recognition of falsifications, identification problems, deliberate or accidental blocking of electronic access by third parties. Liability is excluded for damage which the client suffers due to non-fulfillment of the contractual obligations as well as for indirect damage and consequential damage, such as lost profit or third-party claims.
The provider undertakes no responsibility whatsoever for the security and operational reliability of the software and hardware (such as PC, laptop, modem, telephone, cell phone etc.) used by the user. Any damage suffered by the user or provider which is due to defective devices or software must be borne by the user.
6. Using Internet services from abroad
It is possible that some provisions of foreign law may be violated when using the URL from abroad. Further, encryption may lead to breaches of import/export limitations. The provider cannot accept any liability in any of these cases.
7. Applicable law/place of jurisdiction
All legal relations with the provider and any claims being made in connection with that relationship are exclusively subject to Swiss law, even for users who do not live in Switzerland. The place of jurisdiction is defined by the address listed in the “Legal notice”.
8. Changes and modifications
The provider reserves the right to change these conditions at any time and specifically adapt them to conform with technical and/or legal developments. Corresponding changes will be announced in a suitable form.
9. Correspondence
Our users and collaboration partners are requested to make any corrections to their postal or e-mail addresses themselves online or in writing to the address of the provider listed in the “Legal notice”.
10. Data privacy statement for the use of Google Analytics
